1. Acceptance of Terms

By accessing or using the SoberPath mobile application, website, or any related services ("Services") operated by SoberPath Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. 2. Description of Service

SoberPath is an evidence-based wellness app designed to help people develop healthier drinking habits through tools, tracking, and educational content. Important: SoberPath is NOT designed to treat alcohol use disorder (AUD). Our app is intended for individuals seeking to moderate or reduce their alcohol consumption as a lifestyle choice. If you believe you may have alcohol use disorder, please consult a qualified healthcare professional or addiction specialist.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our Services. By using SoberPath, you represent and warrant that you meet this requirement. Our Services are not intended for use by minors.

4. Subscription and Payment

SoberPath offers a free 7-day trial for new users. After the trial period, a subscription is required to continue accessing premium features. Subscription fees will be charged to your chosen payment method. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You may cancel your subscription at any time through your device's app store settings. Refunds are subject to the policies of Apple Inc. (App Store) or Google LLC (Google Play).

5. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information when creating an account. You must promptly notify us at support@soberpath.com of any unauthorized use of your account.

6. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You will not: (a) use the Services in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to our systems or other users' accounts; (c) use the Services to harass, abuse, or harm others; (d) reverse engineer, decompile, or disassemble any part of the Services; or (e) use automated means to access the Services without our written permission.

7. Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, and software, are owned by SoberPath Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Services without our prior written consent.

8. Disclaimers

Medical Disclaimer: SoberPath does not provide medical advice, diagnosis, or treatment. The content and tools in our app are for informational and educational purposes only. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read in our app.

No Guarantee of Results: While our app is based on evidence-based practices, we do not guarantee specific outcomes. Your results may vary depending on your individual circumstances and commitment to the program.

9. Limitation of Liability

To the maximum extent permitted by law, SoberPath Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill. Our total liability for any claims arising from your use of the Services shall not exceed the amount you paid to us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless SoberPath Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and/or through the app. Your continued use of the Services after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be resolved in the courts located in San Francisco County, California.
